The Supreme Court Judgement on car finance deals is interesting. I will say at this stage I only have a sketchy understanding of the legal technicalities of the case so can only take a global view.
These cases have been as far as the Appeal Court with Judgments in favour of the applicants, the Supreme Court has now seen fit to overturn the earlier Judgments. I realise some on here advocate the buyer beware argument but one has to ask why the lower Courts found in favour of the borrowers. There does seem to be a trend of the Supreme Court making new Law rather than applying earlier or even common Law. I’ve seen this in a number of cases, for example, Private parking penalties, Boris Johnson proroguing Parliament and a very technical case involving service charges on Leasehold properties. I’m sure there are more.
What we have is un-elected Lawyers making Law rather than Parliament. I feel we should be concerned about this, the Supreme Court is of course a Tony Bliar invention.

It’s suggested by many people that the Tribunal system is ad-hoc, informal and great for lay people. That’s utter nonsense, I think that idea is put about to ensure lay people mess their cases up. Tribunal cases are pretty much identical to any other Court case, if Tribunal Judgements are appealed and go to higher Courts the Legal system will chew you up and spit you out anyway. In my own case the Housing Trust were represented by a large firm of Solicitors and a senior Barrister even at Lower Tier.
