One of the BBC defences in a Trump v BBC defamation action is the limited propagation of the offending broadcast, in other words not many Americans saw or heard it. I can make a comment based on my direct experience of a defamation claim brought by me and served on an American based multinational and their magic circle Solicitors.
One of the issues in my case was the limited publication of the offending communication. My Solicitor argued, most importantly, was the lack of control over the dispersal of the libel once it had been published a received by a number of recipients. The other very important factor was the seriousness of the libel, what the effect of the libel would have if it were to become known to someone important like one’s Bank. The other issue would be the potential for blackmail, probably not relevant in the BBC, Trump case.
1) For lack of control of re-publication, this would be massive for Trump, everyone has the Internet or someone that uses it.
2) For seriousness:
a) Consider what the impact of it becoming common knowledge to the public that the BBC are saying Trump killed five people by encouraging a riot.
b) The effect it would have on a Presidential election.
c) Trump is a businessman what effect it could have on his businesses?
d) Trump is a media star, would his career be curtailed?
e) There could have been criminal or Civil sanctions brought against him

I’d be surprised if the BBC can rely on only one view of the impact of releasing this doctored video. Of course, it matters that President Trump was elected even after this scandalous BBC behaviour – but who knows what the impact of the release actually was – he may have won by a bigger majority in each house in the US government, and therefore have been caused much less hassle by the Democrats at every turn since his election. This was not just an on-off type of event – there were multiple possible impacts and results.

So they edited it to appear he encouraged violence in order to show he intended violence? How is that ‘unintentional’? That is an admission that they did intend to say Trump encouraged violence.
This mindset is deeply, deeply embedded in so many of the staff….the only way to stop it is to rip the BBC apart and recruit fresh faces and fresh minds….and train and supervise rigorously in a way that obviously isn’t being done now.
Just reading their latest front-page fiction on this Trump edit. What’s interesting is spotting where they put out a consistent lie : those are the clearly direct from the lawyers and staff have been told exactly what they can and cannot say.
It’s clear now that nowhere in any BBC report are they going to admit it was deliberate. After watching what they did, calling it ‘unintentional’ is a direct lie. So every article they write includes a direct lie.

Having read on this site that nothing on the BBC happens by chance, I believe it. I no longer watch Strictly. But the Daily Mail has an article that one of the contestants dedicated his dance tonight to his Mum who has cancer. I assume the lady has known about her illness longer than this series has been showing. Not for the lady, but for the producers of the show, how wonderful to have a contestant with a good story to produce lots of positive imagery, especially this week. Is the man someone whose popularity in the show was flagging last week, I have no idea. But the whole of Strictly is manipulated, from the choice of music, choice of clothes and even which clip they show during the reprise (good if they want to keep you and a slip up if they want you gone).

During that sequence, we showed excerpts taken from different parts of the speech.
However, we accept that our edit unintentionally created the impression that we were showing a single continuous section of the speech, rather than excerpts from different points in the speech, and that this gave the mistaken impression that President Trump had made a direct call for violent action.
The BBC would like to apologise to President Trump for that error of judgement.
This programme was not scheduled to be re-broadcast and will not be broadcast again in this form on any BBC platforms.

One of the BBC defences in a Trump v BBC defamation action is the limited propagation of the offending broadcast, in other words not many Americans saw or heard it. I can make a comment based on my direct experience of a defamation claim brought by me and served on an American based multinational and their magic circle Solicitors.
One of the issues in my case was the limited publication of the offending communication. My Solicitor argued, most importantly, was the lack of control over the dispersal of the libel once it had been published a received by a number of recipients. The other very important factor was the seriousness of the libel, what the effect of the libel would have if it were to become known to someone important like one’s Bank. The other issue would be the potential for blackmail, probably not relevant in the BBC, Trump case.
1) For lack of control of re-publication, this would be massive for Trump, everyone has the Internet or someone that uses it.
2) For seriousness:
a) Consider what the impact of it becoming common knowledge to the public that the BBC are saying Trump killed five people by encouraging a riot.
b) The effect it would have on a Presidential election.
c) Trump is a businessman what effect it could have on his businesses?
d) Trump is a media star, would his career be curtailed?
e) There could have been criminal or Civil sanctions brought against him
In short it’s a very serious libel indeed.

Of course, it matters that President Trump was elected even after this scandalous BBC behaviour – but who knows what the impact of the release actually was – he may have won by a bigger majority in each house in the US government, and therefore have been caused much less hassle by the Democrats at every turn since his election. This was not just an on-off type of event – there were multiple possible impacts and results.

This mindset is deeply, deeply embedded in so many of the staff….the only way to stop it is to rip the BBC apart and recruit fresh faces and fresh minds….and train and supervise rigorously in a way that obviously isn’t being done now.

I assume the lady has known about her illness longer than this series has been showing. Not for the lady, but for the producers of the show, how wonderful to have a contestant with a good story to produce lots of positive imagery, especially this week. Is the man someone whose popularity in the show was flagging last week, I have no idea.
